The driver of a Disney World bus whose legs were crushed in an accident near Epcot in 2010 was awarded $970,000 by an Orange County jury in a recent ruling. The 47-year-old driver had been a Disney employee for 10 years when he was critically injured in the accident on March 23, 2010. He was driving his bus that day when he collided with the back of a tour bus, which had stopped on Epcot Center Drive. Florida Highway Patrol troopers gave the man a ticket for careless driving in connection with the accident, but his personal injury attorney persuaded the jury that the driver of the tour bus was also at fault for parking her bus in the middle of the road.
The driver of the tour bus was not in the bus at the time the accident occurred. She was standing outside the bus waiting for help to arrive when the Disney bus collided with the back of her bus. She testified during the trial that she had stopped in the middle of the road because she thought her bus was having mechanical problems. The injured driver’s attorney told the jury that if she was having problems but the bus was still somewhat drivable, she should have parked in one of the many nearby parking lots and gotten it off the road before checking on any mechanical problems.
After listening to seven days of testimony in the case, the jury deliberated for three days. They awarded the injured man $970,000 in damages, even though they found him partly to blame for the accident.
