An Orlando man has filed a lawsuit against progressive Select Insurance Co. alleging negligence. The complaint, which extends from a May 13 2013 automobile accident happening at the intersection of Oakridge Road and Millenia Boulevard in Orlando, was filed on May 11 2017 in the 9th Judicial Circuit Court of Florida – Orange County.
In his complaint, the plaintiff alleges that, as a result of the Orlando car crash, he sustained injuries to his body that have caused ongoing pain and suffering, permanent scarring, emotional distress, permanent disability and loss of wages, and significant hospitalization and medical expenses. According to the plaintiff, these injuries are the direct result of the negligent driving of an uninsured driver who hit the plaintiff.
The reason the lawsuit is against an insurance company and not the other driver is because the other driver did not have insurance. Thus, if he were to suit the other driver and win, he would be very unlikely to ever receive any compensation. For this reason, many drivers opt to buy uninsured or underinsured motorist coverage, which pays for your injuries in the case that you are hit by a driver with no insurance coverage. In this case, you can seek compensation from the insurance company from whom you bought the uninsured motorist coverage from.
Having uninsured motorist coverage is important. According to one study, up to 40% of Central Florida drivers are either uninsured or underinsured. On top of this, another study shows that these 40% of drivers are also the ones most likely to drive negligently and be the cause of automobile accidents.
However, as can be seen in the fact that this injured driver is filing a lawsuit against his insurance company, just because you have insurance doesn’t mean getting the compensation you deserve will be easy. For this reason, it is highly recommended that you seek the advice of an experienced Orlando personal injury attorney.
