Two Orlando area teenagers were killed Thursday after a vehicle crashed into the Kissimmee shopping center. According to local police, the Florida automobile accident happened on State Road 192 at the intersection with 1906 W. Vine Street, just east of Thacker Avenue. Based on the police report, the driver was traveling east on SR 192 when he lost control of the vehicle, causing it to slam into the shopping center building.
The two teenage victims were not driving the car, and there were at least five passengers in the vehicle at the time of the crash. Based on news reports, all passengers in the vehicle were teenagers from the same high school and were returning home from soccer practice. One of the victims died at the scene, and the other was pronounced dead at the hospital.
In this case, it is possible that the two victims, along with any other passenger who was injured, could have grounds to seek compensation via Florida’s personal injury law (or via the wrongful death statute in the case of the two deceased victims). However, to do so, they would first need to show that the driver had acted negligently. A person acts negligently when he or she behaves in a thoughtless or careless manner that causes harm or injury to another person. Typically this means doing something that they shouldn’t have done or failing to do something that they should have done. In the case at hand, the question of negligence comes down to what caused the driver to lose control of the vehicle? If they were sending a text message, this could have distracted them, and would be considered a negligent act. If, however, one of the passengers distracted the driver, then the issue of negligent could become more complicated.
