A 30 year old Orlando man died last week following a multi-vehicle accident. According to the Florida Highway Patrol, the crash happened on the eastbound lane of State Road 408, near State Road 417.
The crash happened when a vehicle driven by a 45 year old male from Winter Park was speeding along State Road 408. Unable to stop, he slammed into the rear end of the vehicle driven by the 30 year old Orlando male. The impact caused the vehicle driven by the Winter Park native to overturn and push the other vehicle into a car in front of him. The third vehicle was also pushed into the vehicle in front of it.
The Orlando native was transported to the hospital, where he later died. All other drivers, including the man who caused the accident, were treated for minor injuries.
According to the Florida Highway Patrol, charges are pending.
In the case at hand, the 45 year old Winter Park native will likely face numerous lawsuits. This is because his negligent driving (i.e., his speeding) is the cause of the other drivers’ injuries and, in the case of the Orlando native, death. For the two drivers who were injured, they will be able to seek compensation for their medical bills and treatment, loss of income, pain and suffering and to repair any damage to their vehicles, by filing a personal injury lawsuit against the driver.
For the driver who was killed, his surviving family will likely be able to seek compensation via Florida’s wrongful death law. The Florida wrongful death statute let’s surviving family members, such as spouses and children, to seek compensation for the loss they suffered as a result of the death. This includes compensation for any medical bills and funeral expenses, along with to make up for a loss of income and loss of companionship that the family is likely to suffer.
