One person was killed last weekend in a one vehicle crash that happened in Western Orange County. According to the Florida Highway Patrol, the accident happened on Hartzog Road, just two miles from Walt Disney World and Disney’s Animal Kingdom. While traveling west towards Avalon Road, the driver failed to properly negotiate a curve, causing his Nissan to overturn, strike a small tree and eject the driver. Emergency first responders say that the driver was pronounced dead at the scene.
The cause of the accident remains under investigation.
Although tragic in itself, it is lucky that nobody else was injured – or killed. The roads around the Disney World resorts are often high-traffic areas, and this single vehicle accident could have easily involved multiple vehicles. If the driver had hit and injured another motorist, then that motorist would have been able to seek compensation for their injuries by filing a Florida personal injury lawsuit (however, as in this instance the driver was killed, the lawsuit would likely be filed against his or her estate).
In order to receive compensation for damages caused in an Orlando motor vehicle accident, one must start by showing that the other driver had acted negligently. In the case at hand, we do know that the driver lost control of their vehicle when negotiating a curve. Although we do not know what caused them to lose control, it is likely that they were speeding or driving recklessly – both of which would be found to be negligent acts.
Next, the injured parties would have to show that the driver’s negligent act in fact caused the accident and, as a result of this accident, they have sustained damages. In Florida personal injury claims, common damages include, but aren’t limited to:
- Damage to vehicle: compensation for the actual cash value of your vehicle at the time of the accident, if declared a total loss, or the cost of repairs
- Special damages: including medical bills, lost income and other losses that can be easily calculated
- General damages: these damages are awarded as a way of compensating you for your pain and suffering, future loss of income, etc.
