A 21-year-old Apopka, Florida woman was charged April 7th with DUI manslaughter and DUI with bodily injury. The charges stem from an auto accident in March that killed a 13-year-old girl.
According to Apopka police, the accident occurred on Christiana Avenue near Oak Street. Mackenzie Miller was driving on Christiana Avenue, and at the same time, Trinity Bachmann and her mother were arguing. According to various media reports, the two were arguing about who would sit in the front seat of the vehicle. Bachman wanted to sit in the front seat, but there were other teens riding in the vehicle and one of them sat in the front seat of the vehicle.
In protest, Bachman sat down in the middle of the road. Her mother begged her to get out of the street. As she was attempting to grab the teenager, Miller’s vehicle struck the teenager. She was tossed into the air and landed on the street. The mother also suffered injuries in the accident. Bachman was transported to Florida Hospital Apopka where she was pronounced dead several hours after the accident.
When police officers questioned Miller, they observed the smell of alcohol on her breath and say that her eyes were glassy. An open container of Mike’s Hard Lemonade was found in the center console of her vehicle. Officers conducted a field sobriety test and blood was drawn at the scene. The blood test was sent to the Florida Department of Law Enforcement for examination. Miller was not charged at the scene of the accident because officers could not prove that she was legally intoxicated at the time of the accident.
The test found that Miller was over the legal limit of .08. Her blood alcohol content was .110 and .114. An arrested warrant was issued, and Miller turned herself in to the Orange County Jail. She posted a $3,500 bond and was free until trial. Miller and her mother did not make any statements to the media as they left the jail.
