			<content:encoded><![CDATA[<p>Tired of the number of drunk drivers on Florida’s streets and highways, Mothers Against Drunk Driving (MADD) and many Florida personal injury attorneys are rallying support for a proposed piece of legislation which would target drunk drivers. The legislation would require that ignition interlock devices be installed in the vehicles of all first-time convicted drunk drivers. This is very encouraging and certainly a step in the right direction. However, drunk driving statistics indicate that on average, a drunk driver while drink and drive 87 times before they are arrested for DUI.<br />
<span id="more-374"></span><br />
Ignition interlock devices require that the driver blow into them before the car will start to determine their blood-alcohol content. If the BAC is above a certain level, the car will not start. These devices have been proven to reduce drunk driving, drunk driving accidents and drunk driving injuries and deaths. If lawmakers pass the bill, Florida would be the 13th state in the country to have ignition interlock laws in place. </p>
<p>The bill, SB 924, introduced by Senator Stephen R. Wise, (R-Jacksonville) requires that this device would be used for a specific period of time after the first time a driver is convicted for operating their vehicle under the influence of alcohol. The law would require a court to order a convicted drunk driver not to operate a motor vehicle of any kind unless that vehicle has a functioning ignition interlock device installed. </p>
<p>Even after tougher laws have been passed with increased criminal penalties and huge media campaigns about the dangers and possible consequences of drunk driving, people still drink and get behind the wheel. In 2008, 875 people lost their lives in auto accidents caused by drunk drivers on Florida streets and highways. He was especially upset over a recent incident where he had to avoid striking a large pack of riders and had to leave the road, resulting in a punctured tire. </p>
<p>&#8220;I was so mad I could spit,&#8221; he said. &#8220;They&#8217;re sharing the road with cars going 40 miles per hour or more, and they are spread four or five across, and they won&#8217;t let cars try to pass.&#8221;</p>
<p>Bicycle riders have to obey the rules of the road just as drivers do, but not all bicyclists observe the rules and ride their bikes in a manner that puts others and themselves at risk. <p>&#8220;If people don&#8217;t start heeding our warnings, then we&#8217;ll have to take it to the next step, which will affect their pocketbooks,&#8221; said one sergeant in the Lake County Sheriff’s Office. &#8220;We hate to do that, because maybe they don&#8217;t realize that what they&#8217;re doing is wrong. They&#8217;re required to stop at stop signs, use hand signals to show they&#8217;re turning and to ride in single file closest to the curb.&#8221;</p>

Police say that witnesses reported that the pickup , driven by a 21-year-old Gulf Breeze man, was driving a Dodge pickup faster than the posted speed limit as he came up behind them and passed them on the inside lane. They said that he lost control of the vehicle while trying to change lanes. After he lost control of his truck and struck the median, witnesses said that the truck went airborne and struck the left front of the victim’s 1998 Saturn, causing one of the vehicles to rotate and collide with the other vehicle again. FHP officials said that the accident appeared to be alcohol-related.</p>

			<content:encoded><![CDATA[<p>A New Smyrna teenager, who caused a fatal State Road 44 auto accident, was driving a stolen truck and fleeing police when he struck a SUV and killed the driver—a father of two. DeLand police said that the 19-year-old suspect was driving the stolen truck east on S.R. 44 when he drifted into the westbound lanes and into the path of the 40-year-old father who was westbound near the intersection with Summit Avenue.<br />

Police said the accident victim attempted to avoid colliding with the pickup, but was unable to get out of the way in time. DeLand police spotted the teen driving a truck that he had stolen from his employer. Before the accident, police had spotted the stolen truck at Woodland Boulevard and Beresford Avenue and followed it for a time before pulling the driver over for a traffic stop. The truck had stopped for a brief period of time when the driver accelerated towards an officer in an attempt to run him over, striking him on the arm and shoulder with the passenger side mirror. </p>
<p>&#8220;The suspect had every intent of [doing] whatever it took to get away,&#8221; one police officer said.</p>
<p>Police gave chase and attempted to stop the fleeing truck with stop-sticks, but the truck continued to flee and elude, so the police decided to stop pursuit for safety reasons. </p>
<p>&#8220;It turned out to be him (the stolen truck’s driver),&#8221; Anderson said. &#8220;There was no pursuit. Although we could have pursued him because of the aggravated battery of a law enforcement officer, our officers let him go.&#8221;</p>
<p>Shortly after police stopped pursuing the stolen truck, they heard reports of the accident on their radios. The SUV’s driver died at the scene from his injuries and the suspect was taken to a local hospital where he was treated and released into custody. The teen has been charged with fleeing and attempting to elude, grand theft, aggravated battery on a law enforcement officer and driving with a suspended license. </p>

Florida Highway Patrol accident investigators say that the 81-year-old woman was taken to Calhoun-Liberty Hospital after the accident where she was pronounced dead from her injuries. They say she was driving a 1999 Dodge car northbound on County Road 275 when she failed to observe a stop sign, and violated the right of way of a southbound 1995 Toyota pickup truck on State Road 71.<br />

After running the stop sign, officers say she drove her car into the path of the Toyota that was towing a trailer and utility vehicle. The pickup truck was driven by a 37-year-old Blountstown man who had a 43-year-old passenger, also from Blountstown. After the left side of the elderly woman’s car collided with the front of the pickup truck, police say her car spun out of control and came to a stop on a driveway culvert east of State Road 71. The collision also caused the truck to spin, resulting in the separation of the truck and its trailer and utility vehicle. The trailer ended up on the shoulder of SR 71 and the utility vehicle rolled and ended up on its right side on the other shoulder of SR 71. Both occupants of the Toyota pickup were transported to area hospitals with serious injuries.</p>

The Florida trucking accident occurred near the Pinellas Bayway and left a hole in the on-ramp to Interstate 275 from the Pinellas Bayway that was 28 feet long, 6 feet wide, and 8 inches deep.<br />

<p>Accident investigators with the Florida Highway Patrol said that the cement truck was southbound on I-275 when it attempted to exit onto the Bayway off ramp, hit the center guardrail and flipped, causing the cement tank to fall off the truck. The truck’s cement tank caused the long, broad hole in the pavement when it fell. The Florida Department of Transportation estimated that it would take several weeks for road crews to repair the hole and allow the opening of the exit. The truck’s driver was taken to Bayfront Medical Center and treated for undisclosed injuries.</p>

			<content:encoded><![CDATA[<p>This <a href="http://www.nytimes.com/2010/02/04/business/global/04toyota.html?pagewanted=2&#038;em">article</a> published in the New York Times recently reports that Ray LaHood, Secretary of the U.S. Department of Transportation, has retracted a statement that he made recently regarding Toyota automobiles and the company’s massive recall of many models. The statement that caused LaHood to issue his clarification was one that he made recently, telling Toyota owners to “stop driving it, take it to a Toyota dealer because they believe they have a fix for it.”<br />

At a news conference, LaHood tried to distance himself from his remarks, “What I said in there was obviously a misstatement” and that his intent was to urge Toyota owners, who are understandably very concerned about the safety of their vehicles, to take them to a Toyota dealership and have them checked out. In a statement issued by the DOT, Mr. LaHood said, “I want to encourage owners of any recalled Toyota models to contact their local dealer and get their vehicles fixed as soon as possible.”</p>
<p>The statements address accelerator problems so severe that Toyota has stopped selling eight of their most popular models entirely in an effort to uncover the cause of gas pedals that stick and accelerate out of control. The auto giant made the announcement about the expansion of the recall program recently and has also announced that sales of some models will be suspended until further notice. Toyota is recalling millions of vehicles because the accelerators in some models are sticking, causing some vehicles to accelerate out of control.<br />

<p>The company’s recalled accelerators have been linked to at least 19 deaths in the U.S. and an unknown number of injuries. More than eight million Toyota cars, trucks, SUVs, and crossovers have been recalled in the U.S. in the last four months. Col. John Czernis, director of the Florida Highway Patrol, and Col. David Dees of the Department of Transportation’s Office of Motor Carrier Compliance, head the joint traffic safety initiative. Their goal is to save lives by increasing awareness about unsafe driving acts and habits that often cause auto accidents involving commercial vehicles.</p>

<p>In a press release, Col. Czernis said that Florida state troopers and officers in the MCC will work together to watch for drivers operating their vehicles in unsafe, negligent and potentially hazardous ways and issue citations as necessary. They will pay special attention to unsafe driving habits that often contribute to collisions between passenger vehicles and large trucks and school buses. The campaign is part of the Florida Highway Patrol’s Be Smart, Drive Smart, Florida! The pedestrian accident occurred around 11 p.m. as the woman crossed North Orange Blossom Trail near Sadler Road, a bit north of Zellwood and south of Mount Dora. According to the Florida Highway Patrol, the 30-year-old sheriff’s deputy was reportedly driving northbound in an unmarked Orange County Sheriff&#8217;s Office van on North Orange Blossom Trail when he struck the woman with the van.</p>

<p>FHP officials say that deputy involved in the accident is assigned to the Metropolitan Bureau of Investigation, a group of law enforcement officials from several different agencies. The FHP accident report said that the deputy was wearing a seatbelt at the time of the accident and investigating officers say that alcohol was not a contributing factor in the pedestrian accident. FHP officers say the woman died at the scene of the accident and were investigating whether or not the victim had been drinking before the accident.</p>
