If you’re one of the few people who still don’t buckle a seat belt when driving or riding in a car, truck or SUV, it’s going to cost you. Florida law enforcement officials at the state, county and locals levels are cracking down on drivers disobeying seat belt laws. The Click It or Ticket campaign, which officially ran from March 1 to 15, but is still vigorously enforced, has resulted in 37,000 traffic tickets written, 6,500 of them for failing to buckle up.

The campaign also resulted in 10,000 speeding tickets issued to drivers and 311 arrests for operating vehicles while under the influence of alcohol and/or drugs. Florida began enforcing a new seat belt law June 30, 2009, which allows law enforcement officials to stop any motorist because they are not wearing a seat belt, regardless of any other moving violations. Previously, officers could only write seat belt citations if the driver was pulled over for another infraction.

Officials wanted to stress that even though the campaign is over, their enforcement of this law is not, and they can write tickets when drivers and passengers aren’t wearing seat belts anytime they see an infraction 24/7/365.

“We do it all year round, but we’re participating in this as well,” said one Sergeant of the Orlando Police Department. “It’s a state safety initiative.”

“It’s basically just a zero-tolerance, concentrated effort to observe and cite those who violate the safety belt laws,” said a lieutenant with the Lake County Sheriff’s Office. “Safety belts have a proven ability to save lives and that’s why we take part in this initiative.”

One Orlando traffic safety supervisor who also chairs the Orange County Community Traffic Safety Team said, “The real purpose behind the Click It or Ticket campaign is the public awareness of it.”

Figures provided by the National Highway Traffic Safety Administration indicate that out of eight to ten Floridians, 81.7 percent, buckled their seat belts regularly in 2008. The national average is 83 percent with many states boasting 90 percent seat belt usage or higher.

The law allows officers to write a ticket if either the driver or front seat passenger is not buckled up. Anyone under 18 years of age riding in a vehicle must wear a seat belt regardless of where he or she is sitting.

Attorney James O. Cunningham is one Central Florida car accident lawyer who has seen firsthand the often-tragic aftermath of unrestrained drivers and passengers involved in a collision. He wholeheartedly supports the new law and stepped-up enforcement. A seat belt can literally make the difference between an injury and a death in an auto accident. If you have been injured in an auto accident or someone you care for has been injured or died in an auto accident, Orlando auto accident lawyer James O. Cunningham may be able top help you recover the compensation you may be entitled to under the law. Don’t let big insurance companies pressure you to sign documents that you don’t fully understand.

The Toyota Company currently has a lot on its plate, but even as government officials await a more detailed study of what is causing unintended or sudden acceleration in many Toyota vehicles, reports continue to surface from drivers whose Toyotas are acting strange. One of the latest ones concerns a Toyota Prius that got away from its driver on a southern California road.

According to reports from MSNBC, a 61-year-old driver was operating his Toyota Prius on Interstate 8 near La Posta in the San Diego area when the accelerator pedal of his Prius “jumped” as he accelerated to pass another vehicle. As the vehicle approached speeds of 94 miles per hour, the driver called 911 and eventually stopped the Prius with the assistance of police. According to a MSNBC report, the driver applied both the foot and emergency brake simultaneously on a steep incline in order to stop the vehicle.

To date, Toyota has said that either floor mats or a “sticky” gas pedal are to blame for the recall of millions of Toyota vehicles, balking at the idea that something more complex, such as electronics, could be involved. However, as more drivers report acceleration problems, a real safety hazard for those who own these vehicles and everyone else on the road, government officials are pressing Toyota to step up research and come clean about any potential hidden information that would help provide a permanent fix for this problem. Though Toyota is quickly working on providing a reinforced gas pedal to stop its accelerators from sticking, consumer groups as well as Central Florida Toyota recall accident attorneys are criticizing Toyota’s statements that their techs are “unable to replicate” some of the issues that drivers are reporting. Agencies are asking if new electronic throttle systems may be faulty.

The runaway Prius case did not end in an accident, but other drivers have reported accidents and injuries stemming from a recalled Toyota. If you or someone in your family has been injured in an accident involving a Toyota safety issue, call Orlando Toyota recall injury lawyer James O. Cunningham. With years of experience and a record of accomplishment of fighting for clients, this Central Florida Toyota recall accident attorney will help victims get the compensation they deserve if they are injured because of the puzzling safety problems that are causing this massive Toyota recall.

Executives at embattled auto giant Toyota say the company is working hard to fix problems in its North American market, but some United States legislators and consumer groups are asking whether Toyota is on the right path towards resolution of current safety recalls or just spinning its wheels.

In recent months, reported problems with “sudden or unintended acceleration” in Toyota vehicles have sparked massive recalls involving floor mats and gas pedals. Toyota has identified these two issues as the cause of safety problems in a wide range of vehicles from their current product line. Toyota has posted information about recalled vehicles on their web site. The company is telling drivers to sit tight and wait for instructions on how to get their cars fixed at participating dealerships.

But even as Toyota goes into high gear, handing out potential safety fixes like new reinforced gas pedals and brake overdrive systems, legislators involved in committees and panels monitoring the US Department of Transportation are putting the spotlight on Toyota, demanding a few more details about how the company researched safety issues reported by drivers.

Specifically, many are asking whether electronic throttle systems that computerize the signal from the accelerator pedal are to blame for some of the safety concerns reported by drivers. Toyota has maintained that these systems are safe, but some executives hint that additional causes of sudden acceleration have not been ruled out, which is frustrating those who really want to find the underlying cause of the issue.

New data from the community of Toyota drivers is putting even more pressure on the auto maker: A March 5 New York Times report shows that although Toyota has fixed over a million cars to date, more than 60 drivers have reported problems with their vehicles after having received repairs under the terms of the current recall.

Now U.S. officials are calling for the Toyota Company to clarify its response to questions about their research. Previously, Toyota has said that its technicians “could not replicate” problems with the electronic throttle systems, but as critics point out, this statement does not flatly deny that problems may occur. All eyes are on the giant car company as they continue to pursue internal research for a final answer on what is causing many Toyota vehicles to exhibit faulty acceleration.

Drivers in the Orlando area may be having problems with their Toyota cars, trucks or SUVs, increasing the risk of accidents. Owners of Toyota recall vehicles injured in an accident, as well as passengers, pedestrians or occupants of another vehicle involved in the accident, can look to Orange County Toyota recall accident lawyer, James O. Cunningham, to determine options for legal recourse after such an accident. The telephone numbers for The Law Offices of James O. Cunningham are toll free 888-425-2004 or local 407-425-2000.

Today’s Toyota executives come bearing gifts to the American public. Amid a mammoth recall of several million late model Toyotas and increased scrutiny of the company’s track record on addressing safety issues, Toyota top brass are trying to revive trust and interest in their brand with new financial incentives for customers.

New financial incentives are not the only thing that the Toyota Company is doing to handle the effects of “floor mat” and “sticky gas pedal” recalls that include the majority of their current product line. The company is working to provide a reinforced gas pedal, as well as a brake override system that can shut off the engine when the brake and gas pedals are pressed simultaneously. However, some drivers who have reported sudden or unintended acceleration in Toyota vehicles are not sure that the company’s fixes will be entirely effective, and some are calling on the company to conduct further trials of electronic throttle systems to see if some kind of technical issue is at work in the safety incidents that caused the recalls.

Toyota is claiming a loss of 18,000 sales in February, and as March progresses, its leaders are advertising their new incentives on television. New customers can get no-interest financing for five years on a different Toyota model. Low lease rates apply to nine late model Toyotas. However, that is not all: customers also get two years of free scheduled maintenance for going back to the embattled Toyota brand.

Consumer polls show that while some individuals and families are now distrustful of buying a Toyota, others are jumping back in to get this popular Japanese brand at lower prices than the high sale costs associated with Toyota before the recall. Auto industry experts predict that new and used Toyota’s pricing will match closely to the price tags of other vehicles on the North American market.

Previous reports associate 43 fatalities and numerous injuries with recalled Toyotas. It’s important that Toyota drivers stay current on new advice for fixing sudden or unintended acceleration in their vehicles. It’s also important that consumers across the nation know where to turn for help with injuries when a defective or recalled Toyota causes personal harm in an accident.

Orlando Toyota recall accident lawyer James O. Cunningham can help Central Florida residents deal with an injury or fatality from an accident with a recalled Toyota vehicle. If you or a family member sustained injuries in an accident involving one of these vehicles, call the Law Offices of James O. Cunningham to get help with seeking compensation. Victims of Toyota recall related accidents can call toll free at 888-425-2004 or locally at 407-425-2000 or submit a form online for a response from our professional team.

Those who watched Congressional hearings on Toyota’s recall and safety issues Tuesday saw Toyota executive James E. Lentz III do an about-face on his previous adamant assurance that fixing accelerator pedals would lead to successful repairs for Toyota vehicles that owners reported were vulnerable to sudden acceleration.

U.S. government officials including the House Energy committee Chairman Henry Waxman questioned Lentz about the truth on why Toyota vehicles seem to be accelerating out of control so often on the American roadway. In his responses, Lentz stated that electronic throttle systems are unrelated to the sudden acceleration problem.

Issues with the Toyota recall and safety problems have reached a crescendo as more research leads to conclusion that the electric throttle systems had something to do with the unsafe accelerations that are continuing to puzzle top Toyota staff, as well as a third-party firm that the company brought in to do extensive research on their cars.

Despite many consumer reports of faulty acceleration, witnesses at the congressional hearing reported that Toyota has previously stalled on the issue.

What really infuriates many consumer advocates and others is the way that Toyota seems to analyze the dangerous scenario. A witness Tuesday testified that Toyota staff were “unable to replicate” her sudden acceleration problem. This kind of response conforms to the current report coming from Toyota’s own research firm, which says staff is unable to find or replicate the problems commonly reported and recognized, even by the company.

Saying that a technician or engineer “can’t find” evidence of an issue is a very tricky way to sidestep questions about what is causing a phenomenon that all seem to agree is happening. This kind of disingenuous response to a quickly growing concern is part of what makes this Toyota recall so newsworthy, along with the obvious danger to drivers that sudden acceleration can cause.

Though Toyota is looking at solutions to the safety issue including advanced brake technology, it is unlikely that U.S. consumers and their government are going to settle for anything less than a factual explanation of why Toyota vehicles are manifesting acceleration problems. Lentz, for his part, admitted in testimony that Toyota had made mistakes and “lost sight” of its customers. How much more the car company is willing to give on this issue remains to be seen, but with the recall of millions of cars and no end in sight for the investigation of the acceleration problem, those with a stake in tomorrow’s auto industry agree that the leaders at Toyota have their work cut out for them.

As new data continues to surface about Toyota, and why many of its recalled cars tend to accelerate out of control, Toyota representatives went before the U.S. House Committee on Oversight and Government Reform Wednesday, Feb. 24. The testimony of Akio Toyoda, the company’s president, and other staff, was the second in two days, as Toyota officials presented to other panels Tuesday, Feb. 23.

The big takeaway from Wednesday’s session for many was the defensive position taken by U.S. Dept. of Transportation Secretary Ray LaHood, who bristled as he took tough questions about his office’s relationship with Toyota.

LaHood pointed to massive recalls as proof that Toyota did not enjoy a privileged relationship with the U.S. Transportation Department, but many in government continue to question whether lax oversight contributed to problems that they say Toyota has been able to hide for quite a while.

Although there are a number of issues facing Toyota today, the main one seems to be sudden acceleration in many of its newer cars. Testimony Wednesday included questioning on a timeline for Toyota’s response, where internal documents seemed to indicate that the company had tended to minimize safety issues in order to retain profits.

At issue is Toyota’s previous denial that electronic throttle systems were responsible for sudden acceleration, where the company had blamed the problem on recalled floor mats. Under further scrutiny, officials found that floor mats were not responsible for the acceleration. Toyota now faces more controversy over a company that it hired to test the electronic throttle systems, which found no technical issues with the complex technology; even as evidence continues to mount that the electronic throttles played a role in the current recall situation.

Along with all of this frenzied fact-finding, which many feel paints a dark picture of Toyota, some consumer advocates and others were sharp in criticizing what they saw as a lack of remorse on the part of Mr. Toyoda, who took the stage without a lot of emotion to field questions from government representatives. According to official reporting, Toyoda continued to maintain through the end of his testimony that his company cars are safe for U.S. drivers.

As more details become available about the Toyota recall and the sudden acceleration of many of its cars, consumers are looking very critically at fancy new electronic systems, while questioning the future of Toyota and whether it deserves the highest safety marks and general popularity it has enjoyed for several decades in the North American market. U.S. government groups will continue to investigate safety threats related to the Toyota recall and any reported issues with its vehicles on the road.

The nwfDailyNews reports that a 60-year-old Navarre man died from injuries he received when his car was struck by an airborne pickup truck. The Florida auto accident occurred on U.S. Highway 98 close to the intersection with South Circle Westbound.

Police say that witnesses reported that the pickup , driven by a 21-year-old Gulf Breeze man, was driving a Dodge pickup faster than the posted speed limit as he came up behind them and passed them on the inside lane. They said that he lost control of the vehicle while trying to change lanes. After he lost control of his truck and struck the median, witnesses said that the truck went airborne and struck the left front of the victim’s 1998 Saturn, causing one of the vehicles to rotate and collide with the other vehicle again. FHP officials said that the accident appeared to be alcohol-related.

People who choose to drink alcohol and drive know very well that their behavior is tremendously irresponsible and reckless and puts the lives of innocent people at risk. They consciously make a choice to be irresponsible and knowingly exhibit the most negligent kind of behavior that often ends in tragedy. Despite tougher criminal penalties, public service campaigns about the dangers of drinking and driving and the many dangers of driving drunk, people still drink and get behind the wheel thinking that drunken driving accidents happen to other people. That is, until they cause a drunk driving auto accident that kills or severely injures someone.

A New Smyrna teenager, who caused a fatal State Road 44 auto accident, was driving a stolen truck and fleeing police when he struck a SUV and killed the driver—a father of two. DeLand police said that the 19-year-old suspect was driving the stolen truck east on S.R. 44 when he drifted into the westbound lanes and into the path of the 40-year-old father who was westbound near the intersection with Summit Avenue.

Police said the accident victim attempted to avoid colliding with the pickup, but was unable to get out of the way in time. DeLand police spotted the teen driving a truck that he had stolen from his employer. Before the accident, police had spotted the stolen truck at Woodland Boulevard and Beresford Avenue and followed it for a time before pulling the driver over for a traffic stop. The truck had stopped for a brief period of time when the driver accelerated towards an officer in an attempt to run him over, striking him on the arm and shoulder with the passenger side mirror.

“The suspect had every intent of [doing] whatever it took to get away,” one police officer said.

Police gave chase and attempted to stop the fleeing truck with stop-sticks, but the truck continued to flee and elude, so the police decided to stop pursuit for safety reasons.

“It turned out to be him (the stolen truck’s driver),” Anderson said. “There was no pursuit. Although we could have pursued him because of the aggravated battery of a law enforcement officer, our officers let him go.”

Shortly after police stopped pursuing the stolen truck, they heard reports of the accident on their radios. The SUV’s driver died at the scene from his injuries and the suspect was taken to a local hospital where he was treated and released into custody. The teen has been charged with fleeing and attempting to elude, grand theft, aggravated battery on a law enforcement officer and driving with a suspended license.

The jcfloridan.com reports that a Calhoun County auto accident claimed the life of an elderly Marianna woman and sent two men to a local hospital with serious injuries. Florida Highway Patrol accident investigators say that the 81-year-old woman was taken to Calhoun-Liberty Hospital after the accident where she was pronounced dead from her injuries. They say she was driving a 1999 Dodge car northbound on County Road 275 when she failed to observe a stop sign, and violated the right of way of a southbound 1995 Toyota pickup truck on State Road 71.

After running the stop sign, officers say she drove her car into the path of the Toyota that was towing a trailer and utility vehicle. The pickup truck was driven by a 37-year-old Blountstown man who had a 43-year-old passenger, also from Blountstown. After the left side of the elderly woman’s car collided with the front of the pickup truck, police say her car spun out of control and came to a stop on a driveway culvert east of State Road 71. The collision also caused the truck to spin, resulting in the separation of the truck and its trailer and utility vehicle. The trailer ended up on the shoulder of SR 71 and the utility vehicle rolled and ended up on its right side on the other shoulder of SR 71. Both occupants of the Toyota pickup were transported to area hospitals with serious injuries.

Elderly drivers on Florida’s streets and highways are much more likely to suffer very serious and even fatal injuries in auto accidents. Many no longer have the reflexes and driving skills that they once had and as a result, they must take and pass driving competency tests far more often than younger drivers do to ensure that they can safely operate their vehicles. If they are involved in a car accident, they face a long and very expensive road to recovery and may not have the financial means to pay their medical bills, putting them and their families in a very difficult position.

If you have been injured or a family member has been injured or killed in an auto accident, Orlando auto accident lawyer James O. Cunningham may be able to assist you in the recovery of the financial compensation you deserve to help pay medical expenses and other bills.

This article published in the New York Times recently reports that Ray LaHood, Secretary of the U.S. Department of Transportation, has retracted a statement that he made recently regarding Toyota automobiles and the company’s massive recall of many models. The statement that caused LaHood to issue his clarification was one that he made recently, telling Toyota owners to “stop driving it, take it to a Toyota dealer because they believe they have a fix for it.”

At a news conference, LaHood tried to distance himself from his remarks, “What I said in there was obviously a misstatement” and that his intent was to urge Toyota owners, who are understandably very concerned about the safety of their vehicles, to take them to a Toyota dealership and have them checked out. In a statement issued by the DOT, Mr. LaHood said, “I want to encourage owners of any recalled Toyota models to contact their local dealer and get their vehicles fixed as soon as possible.”

The statements address accelerator problems so severe that Toyota has stopped selling eight of their most popular models entirely in an effort to uncover the cause of gas pedals that stick and accelerate out of control. It is estimated that the faulty gas pedals in Toyota vehicles has caused the deaths of at least 19 people in auto accidents and resulted in injuries for countless others.

LaHood’s department aggressively addressed the Toyota gas pedal recall and LaHood took credit recently when Toyota announced that they would stop building and selling the eight models involved in the recall. He claimed that Toyota did not take such drastic measures until he and his department urged the automaker to do so. At a recent press conference, he told reporters that he planned to call Toyota president Akio Toyoda personally regarding the recalls and the sticking gas pedals.

“I’m going to take the initiative to have a conversation with Mr. Toyoda very soon, to talk to him about how serious this is and to make sure that he understands,” Mr. LaHood said. “I think he understands, but I’ve never talked to him. I just feel like I need to have a conversation with him.”

Toyota’s faulty accelerators have been cited as the cause of countless auto accidents in the U.S. that resulted in injuries, fatalities and loss. If you or someone you care for has been hurt or killed in an accident caused by a sticking accelerator, Orlando Toyota recall accident attorney James O. Cunningham may be able to help. He has represented victims and families affected by faulty products in product liability cases since 1977. He has the experience and resources to take on big corporations that cause harm people through defective products. To schedule a free consultation with Orlando Toyota recall accident lawyer James O.
